India tightens norms for virtual health influencers for endorsing products, advice

Indian Consumer Affairs Department on Thursday tightens norms for virtual health influencers or health experts for endorsing products or advice.

The new norms are in addition to the Guidelines for Prevention of Misleading Advertisements and Endorsements, released on 9th June 2022.
The new norms are aimed at dealing with misleading advertisements or claims and ensuring transparency in health and wellness endorsements.
Now, such influencers must disclose that they are certified while sharing information, promoting products or services or making any claims.
In addition, they must provide clear disclaimers to ensure that they aren’t substituted for professional medical advice, diagnosis or treatment.
The disclaimers are mandatory while claiming health advantages from food items or others in preventing or treating or curing diseases.
However, advices as ‘Drink Water and Stay Hydrated’,
‘Exercise Regularly and Be Physically Active’,
‘Reduce Sitting and Screen Time’,
‘Get Enough Good Sleep’,
‘Drink Turmeric Milk for faster recovery’,
‘Use sunscreen daily to protect from harmful UV rays’,
‘Oiling of hair for better growth’ are exempt from these regulations.
These influencers should also clearly distinguish between their personal views and professional advice. They should also refrain from making specific health claims without substantiated facts.

“The Consumer Affairs department will actively monitor and enforce these guidelines.
Violations may lead to penalties under the Consumer Protection Act 2019 and other relevant provisions of the law.
We are committed to safeguarding consumer interests and promoting a fair and transparent marketplace, especially in digital space,” an official said.
